About the Promotion
1. This Promotion is offered by Employment Hero Pty Ltd (ABN 11 160 047 709) and its affiliates (Employment Hero).
2. During the Promotion Period, any Eligible Participant that signs up as a Referral Partner with Employment Hero, submits at least 1 Promotion Qualified Referral through the Employment Hero Partner Portal (Partner Portal) and whose referral completes a live demonstration with an Employment Hero representative will receive the Reward of a $250 NZD GiftPay gift card (Promotion).
3. This Promotion will take place from 12:00am on 13 January 2025 to 11:59pm on 31 March 2025 (Promotion Period).
How to qualify for the Promotion?
4. To qualify for the Promotion, you must:
a. Have received communication of this offer either via phone or email from an Employment Hero representative;
b. Be a business registered and operating in New Zealand;
c. Sign up as a Referral Partner, including accepting our Referral Partner Terms and Conditions during the Promotion Period;
d. Submit the Promotion Qualified Referral through the Partner Portal; and
e. Open and maintain an active Partner Portal account.

How to enter?
5. To enter the Promotion, Eligible Participants must submit at least 1 Promotion Qualified Referral to Employment Hero during the Promotion Period through the Partner Portal, and have that Promotion Qualified Referral complete a live demonstration with an Employment Hero representative during the Promotion Period.
Promotion Qualified Referral
6. A referral is a Promotion Qualified Referral if the lead:
a. is referred through the Partner Portal during the Promotion Period;
b. is not a person, entity or organisation who is a current customer of Employment Hero (Existing Customer);
c. is not a person, entity or organisation with whom Employment Hero is in active discussions or negotiations to be provided with the Services (Existing Prospect); and
d. completes a live demonstration with an Employment Hero sales representative during the Promotion Period.
Reward
7. An Eligible Participant who submits at least 1 Promotion Qualified Referral in accordance with these Terms and Conditions will receive the reward of a $250 NZD GiftPay gift card in addition to the standard referral commission payment they receive under the Referral Partner program (Reward).
8. A partner can only claim 1 Reward during the Promotion Period. That is, additional referrals that purchase Employment Hero products will not trigger a secondary Reward payment.
9. The Reward will be paid shortly after the Promotion Period has ended.

11. Any personal data collected during this Promotion is managed in accordance with the Employment Hero Privacy Policy.
Liability
12. Except for any liability that cannot be excluded by law, Employment Hero (including its officers, employees and agents) excludes all liability (including negligence), whether direct, indirect, special or consequential, for any loss or damage arising in in connection with this Promotion, including any:
a. technical difficulties or equipment malfunction (whether or not under Employment Heroโs control);
b. theft, unauthorised access or third party interference;
c. entries that are late, lost, altered, damaged or misdirected (whether or not after Employment Hero receives it) due to any reason beyond Employment Heroโs reasonable control;
d. variation in Reward value, description or variation of product due to non-availability to that stated in these terms; or
e. tax liability incurred by an Eligible Participant.
General Terms
13. The Reward is not transferable to any other products or cash.
14. All products advertised for purchase on the Employment Hero website during the promotional period are eligible toward the reward qualification criteria.
15. Employment Hero reserves the right to terminate the Promotion early in full or in part at our absolute discretion.
16. Laws may apply to you or to us as a result of your specific location. If this is the case, and if those laws are inconsistent with any part of these terms, those laws will prevail to the extent of the inconsistency.
17. If any part or provision of these terms are invalid, unenforceable or in conflict with the law, that part or provision is replaced with a provision which, as far as possible, accomplishes the original purpose of that part or provision. The remainder of these terms will be binding on the parties.
18. These terms are governed by the laws of New South Wales, Australia and the parties submit to the non-exclusive jurisdiction of its courts.
